Crowdfunding for digital accessibility
Project objective
The project aims to improve digital participation for people with disabilities by reducing digital barriers on the organization's website using Eye-Able software solutions. Funding will be provided through a crowdfunding campaign on the Crowd-Now platform.
Financing model and process
· The crowdfunding campaign is launched and promoted by the organization.
· The target amount is based on Eye-Able's defined license price for the agreed term (e.g., 12 months).
· This contract only comes into effect once the defined target amount of the associated crowdfunding campaign has been fully reached and transferred by Fairplaid GmbH to the applicant licensee.
· Eye-Able is not obliged to perform as long as this condition precedent has not been fulfilled. If the target amount is not reached, the contractual obligation of both parties shall lapse without replacement. If the target amount is not reached within a specified period, Fairplaid GmbH will refund the donations to the donors and the project will not be implemented.
· After receipt of the donation, a contract between Eye-Able and the organization is concluded, on the basis of which the license is provided.
Contractual partner and payment obligation
· Eye-Able's contractual partner is exclusively the organization.
· The organization does not acquire the license exclusively from its own funds, but through third-party funding via Crowd-Now.
· The organization has a direct payment obligation in the amount of the bid sum; there is no obligation to make additional payments if the target is not reached.
License provision by Eye-Able
· The organization receives a non-transferable software license for the use of Eye-Able solutions on the website specified in the project.
· The license will only be provided after the full donation has been received
(contract subject to a condition precedent).
· The license term is at least 12 months; automatic renewal is excluded.
Requirements for project launch
In order for a crowdfunding project to be launched within the framework of this funding, the organization must:
· be recognized as a non-profit organization or be organized as a registered association (proof required),
· name the planned website for which accessibility is to be implemented,
· ensure that the funds collected are used exclusively for this project (earmarking),
· submit a project description to Crowd-Now in accordance with the specifications,
· accept the project conditions and the Master Service Agreement (MSA) of Eye-Able and the terms and conditions of Crowd-Now.
Legal consequences and notes
· Eye-Able is not responsible for the success or implementation of the crowdfunding campaign.
· The license is granted exclusively under the conditions specified in the separate project agreement (after successful fundraising).
· The organization undertakes to present the project transparently and to report publicly on the results achieved after implementation.
Data protection
The organization is responsible for complying with all data protection requirements in its communications and during the course of the project. Eye-Able only receives data from the organization, not from donors.
Exclusion of professional sports clubs
Organizations that can be classified as professional sports clubs or profit-oriented organizations are excluded from participating in this crowdfunding promotion. This applies in particular to:
· Clubs or organizations
that are represented by a licensed team in one of the three highest leagues of an Olympic team sport (e.g., 1st to 3rd Bundesliga, Handball Bundesliga, DEL, BBL, etc.),
· Organizations in the legal form of a corporation (e.g., GmbH, AG),
· Organizations with non-profit status,
· Organizations with economic business operations that go beyond the scope of charitable purposes and are primarily focused on marketing, sponsorship, or ticketing.
Eye-Able Web Inclusion GmbH reserves the right to review each application individually and to reject project applications that do not meet this purpose.
This funding is expressly intended for non-profit organizations with a focus on inclusion and social added value.
