The European Accessibility Act

The EAA requires member states to make online commerce accessible to consumers. It focuses on products and services that are most important to people with disabilities. In Germany, this provision is implemented in the "Barrierefreiheitsstärkungsgesetz" (BFSG). The European Accessibility Act must be implemented into national law by all EU countries by June 28, 2025.

What does the law say about accessibility?

The law promotes equality and accessibility for products and services, requiring barrier-free access, information, communication, workplace adaptation, and the participation of people with disabilities in all areas of society. Non-compliance can result in fines of up to 100,000 euros, depending on the administrative offense.

What does accessibility mean anyway?

The German Disability Equality Act (BGG), in effect since 2002, defines accessibility as the ability of people with disabilities to find, access, and use facilities, transportation, information systems, communication tools, and other designed areas of life in the same way as people without disabilities, without difficulty or outside assistance. This ensures that people with disabilities can use everything independently, just like anyone else.

Absolute necessity for people with disabilities

Around 1 billion people worldwide have a disability. Of these, 215 million are visually impaired and therefore have major problems with website usability. It is no longer enough just to make buildings accessible; inclusion must also be practiced on the Internet. All people should be able to participate equally in digital media.

Micro-enterprises that provide services are exempt from the law. However, micro-enterprises that place products on the market are covered by the EAA.
