What is the Accessibility Enhancement Act?
The Accessibility Enhancement Act has been fully in force in Germany since June 28, 2025, as the national implementation of the European Accessibility Act. This means that private companies are now also required to meet accessibility standards in accordance with the BFSG requirements.

Significance of the Accessibility Enhancement Act for online commerce
With the BFSG coming into force on June 28, 2025, online shops are required to ensure digital accessibility. According to the Accessibility Enhancement Act Ordinance (BFSGV), online shops must be appropriately perceivable, operable, understandable, and robust. Websites must have basic functions that are tailored to the individual needs of people with disabilities and enable the use of the website with assistive technologies. Possible consequences of a warning letter
Online shops face financial risks due to potential legal fees or possible injunctions, which can result in further legal costs. Preliminary injunctions obtained by the party issuing the warning letter can restrict the business operations of the company receiving the warning. In addition, contractual penalties are possible in the event of a repeat breach of duty.
It is not yet possible to assess whether the initial warning attempts will turn into a wave of warnings. In principle, companies should remain calm in such cases and seek legal assistance. The latest rulings of the Federal Court of Justice (BGH) from March 2025 on warnings for violations of the General Data Protection Regulation (GDPR) can be interpreted as a signal for the future of BFSG warnings. According to these BGH rulings, data protection violations are subject to warnings from the highest court. This means that small and medium-sized companies in particular face not only fines from supervisory authorities for violations, but also warnings from competitors or associations.
